Lex Sarah and Lex Maria

Lex Sarah applies within social services, and Lex Maria applies within health care. Both concern reporting serious incidents and misconduct.

Lex Sarah

Everyone working in social services is legally required to report misconduct or the risk of misconduct. If you believe an incident you report may lead to a Lex Sarah investigation, you must indicate this in the incident report.

Types of Abuse to Report

  • Physical abuse: Hitting, pinching, shaking. This may also include abuse between residents, for example in a care home.
  • Psychological abuse: Threats, harassment, degrading treatment, or punishments.
  • Sexual abuse: Unwanted sexual suggestions or actions.
  • Financial abuse: Theft, embezzlement, or extortion.

Other Misconduct

  • Not receiving sufficient food, drink, or help with hygiene.
  • Lack of support with oral care, washing, or cleanliness.
  • Disrespectful treatment where self-determination, safety, and dignity are not respected.

Documentation and Action

When misconduct or abuse is reported, it must be documented and investigated as soon as possible. Shortcomings must be corrected or removed without delay.

Lex Maria

In health care, all staff must report events that have caused or could have caused serious harm or patient injury. This is called a Lex Maria report.

Oversight

The Health and Social Care Inspectorate (IVO) is responsible for handling reports made under both Lex Sarah and Lex Maria.
