When can you appeal?
You can appeal decisions from the social welfare committee if you are not satisfied with the assistance or support you have received. This applies, for example, if:
- you do not receive the assistance you applied for,
- you are granted less assistance than you applied for,
- you are granted other assistance than what you applied for,
- the municipality reduces or withdraws previously approved support,
- you are dissatisfied with a decision about fees.
How to write your appeal
Your appeal must be in writing and either handed in to the case officer who made the decision or sent to Socialförvaltningen, 961 86 Boden. The appeal must reach the municipality within three weeks from the day you received the decision.
Make sure to include:
- which committee and case officer made the decision,
- the protocol or letter where the decision is described,
- which decision you are appealing,
- why you are dissatisfied and which errors you believe exist,
- how you want the decision to be changed,
- your name, personal identity number, address and telephone number,
- any documents that support your appeal.
If you are represented by an agent, the agent can sign the appeal, but then you must attach a power of attorney.
What happens next?
When the social welfare committee receives your appeal, they will first review it. If the decision can be changed in the way you requested, it will be corrected directly. If not, the case will be forwarded to the Administrative Court in Luleå, which will examine your appeal.
Judicial review
If a decision cannot be appealed through an administrative appeal, you can instead request a judicial review. The court then examines whether the decision is legal, but it cannot make a new decision. Anyone registered as a resident in the municipality has the right to request a judicial review.
