Compensation for damages streets and traffic

Eligibility for compensation
Place and responsibility
Compensation may be granted if Boden Municipality or a contractor working for the municipality caused the damage through negligence or intent. The incident must have happened on municipal land or in an area where the municipality has road management responsibility.
Knowledge of the defect
The municipality must have known about the defect and failed to correct it within a reasonable time to be held responsible.
Events that do not create responsibility
The municipality is not responsible for damage caused by other road users, such as objects dropped onto the roadway or violations of traffic rules.
What you must prove
You, as the injured party, must prove that the municipality or its contractor caused the damage through negligence or intent. Describe how the municipality failed in its road management duty and document everything with care.
Example: slip and fall on ice
The municipality can be responsible if it had knowledge of icy conditions but did not take action or did not plan maintenance based on weather forecasts. Work must be prioritised because all streets cannot be maintained at the same time.
Example: trip and fall
The municipality can be responsible if it knew about the defect but did not repair it or did not warn road users within a reasonable time. Defects are often discovered only after an injury has occurred and been reported.
Example: pothole
The municipality can be responsible if it knew about the pothole but did not repair it or did not warn within a reasonable time. Potholes can form quickly, and the municipality often learns of them through a damage claim or a fault report.
Example: object on the roadway
Objects are often dropped from vehicles. The municipality cannot remove items it does not know about and cannot be held responsible for events caused by others.
Example: damage during roadworks
The contractor carrying out the work must follow laws and regulations. If the work affects motor traffic, pedestrian traffic, or bicycle traffic, a traffic management plan must be approved. Claims in such cases must be directed to the responsible contractor.
How to file a claim
Contact your insurance company first
First contact your insurance company, such as for home insurance, accident insurance, or motor insurance. Costs that your insurance does not cover, such as your excess, can be claimed from the municipality if the municipality is responsible.
Document the incident
Photograph the location and the damage. Save receipts, notes, and other information. If needed, make a simple sketch of the course of events.
Answer thoroughly in the claim
Describe what happened, where and when it happened, and why you believe the municipality is responsible. You, as the injured party, have the burden of proof.

When an individual seeks damages from Boden Municipality, the matter is governed by civil law. The municipality’s decision can be reviewed further.
If you disagree with the decision
You can apply to sue the municipality in a general court and present your case yourself or through a representative that you engage.
