Compensation if you are injured in healthcare (patient injury insurance)
How compensation works after an injury linked to care and how to file a claim.

When the patient injury insurance applies
You can claim compensation if you are injured during examination, care or treatment in Swedish health or dental care that the municipality provides. It also applies when private providers deliver care on behalf of the municipality. You have a right to claim under the Patient Injury Act.
Events that may lead to compensation
- Injury that could have been avoided with correct care
- Injury caused by a fault in, or incorrect handling of, a medical device or equipment
- Incorrect or delayed diagnosis that worsened your condition
- Infection acquired in connection with care or treatment
- Accident during health or dental care, during patient transport, or due to damage in premises or equipment
- Injury due to incorrect medication, for example wrongly prescribed or dispensed medicine
What is not covered
- Traffic injuries are normally handled by motor third party liability insurance. Work injuries are handled first by the insurance for occupational injuries
- Loss of personal belongings, for example glasses, wallet or dental prosthesis
- Issues about treatment, attitude or resources in care are not examined under patient injury insurance
- Infection from your own bacteria or injury that occurred during correct treatment of a life-threatening condition
- Side effects from correctly prescribed medicines are reported to the Pharmaceutical Insurance
Deductible and time limits
Deductible
A deductible under the Patient Injury Act is deducted from any compensation.
Time limits for reporting
You must report within three years from when you became aware of the injury, that it may be linked to treatment and which insurer applies. There is an absolute time limit of ten years from when the injury was caused.
How to file a claim
Who submits the claim
You, as the patient, decide whether to report the injury and you submit the claim to the patient injury insurer.
Information you need to provide
The insurer needs details about:
- your personal and contact details, occupation and bank details
- the care provider, any other providers you visited and the dates of treatment
- whether the injury is linked to, for example, a traffic accident or an occupational injury
- what happened and which injury you are reporting

Your personal data
How your data is used
The insurer needs to process necessary personal data, including health data, to assess the claim. Data may be shared with a medical adviser and, when required by law, with authorities. Processing follows data protection rules.
Consent and your rights
By signing the claim, you consent to necessary processing of your data to assess your case. You can withdraw your consent by contacting the insurer.
