Right to a fee
You are entitled to a fee for the work you perform in your assignment, as well as compensation for necessary expenses. As a rule, the person you represent (the principal) should pay both the fee and the compensation for expenses.
Who pays the fee?
The income and assets of the principal determine whether they or the municipality pay. If the principal’s income and assets are low, the municipality may cover the cost.
Decision on the fee
The Chief Guardian Committee decides the amount of the fee and who will pay it. The assessment is based on the scope of the assignment and your reporting. You may never decide the fee yourself or take it in advance.
When the principal is the employer
If the principal pays the fee, they are considered the employer under the law. In this case, tax and social security contributions must be paid to the Swedish Tax Agency, and a simplified employer’s declaration must be submitted. More information is available at Skatteverket.se.
If the principal has limited finances
If the principal has low income or few assets, the cost of the fee may sometimes be included among the expenses that should be covered first. This means the principal can keep more money for daily living costs.
There are also possibilities for compensation:
- The Swedish Enforcement Authority may take the fee into account in debt collection or debt restructuring.
- The Swedish Social Insurance Agency may in some cases grant disability allowance.
- The fee cost may affect the calculation of care fees for home care or special housing.
