When is consent required?
As a legal guardian, trustee, or custodian, you must always obtain the consent of the Chief Guardian Committee before buying or selling real estate, a tenant-owned apartment, or a leasehold on behalf of the person you represent. The consent is intended to protect the finances and rights of the principal or the child.
How to apply
You apply in writing using a special form. In the application, describe the measure (purchase, sale, or other action) and why it should be approved.
Documents to include with the application:
- Purchase agreement or transfer contract, signed by both buyer and seller.
- Property tax certificate from the most recent property taxation.
- Mortgage certificate showing any loans on the property.
- Valuation certificate from an independent valuer, or a written statement from a broker about advertising and bidding.
- Statement from the principal or the child, if possible.
- Certificate from a doctor or other authorised professional, if needed to show whether the principal understands the measure.
After the transaction is completed
When the sale or purchase has been carried out, you must report to the Chief Guardian Committee:
- For a sale: submit the settlement statement and a bank statement showing that the money has been deposited into a restricted account in the name of the principal or the child.
- For a purchase: submit a copy of the title deed or mortgage certificate (for real estate). For a tenant-owned apartment, submit a certificate from the housing cooperative showing that ownership has been transferred.
